TERMS AND CONDITIONS

 

 

The parties to the Contract

The Contract is an agreement made between you, the "Hirer", and the "Leader" of the "Act". An Act may be a group of performers, or a single performer, discotheque or other service provider. The "Leader" may be the Leader of a group, or the performer or service provider themselves.  The PartyJazz Agency acts as agent on behalf of the Act and provides administrative services.

 

Booking Fee

Unless otherwise agreed by prior arrangement with PartyJazz, the Booking Fee will be payable immediately after you have agreed to these Terms and Conditions or at the latest within 24 hours of doing so.

 

Payment of Balance

Unless otherwise agreed by prior arrangement with  PartyJazz, the Balance will be payable to the Act on the date of performance by cheque or in cash.

 

Changes to the Contract

Any changes to the terms of the Contract must be agreed by both parties.

 

Cooling-off Period

Unless the date of the event is less than 14 days from the date of agreeing this Contract, the Hirer can cancel without penalty up to seven working days after agreeing the Contract and the Booking Fee will be returned in full.

 

Cancellation by the Hirer

Excluding cancellations made during the Cooling-off Period, the Booking Fee is non-returnable. If the Hirer cancels this booking, a Cancellation Charge will be payable by the Hirer on the following scale:

Less than 45 days before date of event    100% of balance

 

In all cases, where the Act is able to secure an alternative booking of comparable value on the same date, at their discretion they may waive all or some of the Cancellation Charge.

 

Outstanding payments

The Hirer is advised that outstanding payments will be referred to a debt recovery company and that the Hirer will be liable for payment of any charges and legal fees incurred in the recovery of outstanding payments.

 

Cancellation by the Act

Cancellation by the Act is not allowed without the agreement of the Hirer. If an act wishes to cancel,  PartyJazz would seek to offer an alternative act but it is at the Hirer’s discretion whether to accept the alternative.

 

Sickness

If an Act member is unable to perform because of sickness or accident, the Leader will provide a substitute of comparable standard.

 

Performance times

If the Act is prevented from starting on time or completing the contracted maximum live performance time through reasons beyond their control (such as the event running late or the performance area not being ready), the Act may agree to finish later than the contracted finish time, but this is entirely at the Act's discretion and may entail payment of an additional fee.

 

Use of Act’s equipment

Any equipment and instruments belonging to the Act are not available for use by anyone else except by specific permission of the Leader.

Health and Safety

The Hirer should ensure as far as is reasonably practicable that all necessary steps are taken to provide safe working conditions for the Act.

The conduct of all entertainment agencies comes under the Employment Agencies and Employment Businesses Regulations 2003. Under these regulations, The PartyJazz Agency operates as an “employment agency” having been given authority to act on this basis on behalf of the acts we promote.
